Dear Ms. Barker:

Your professional incompetence is overwhelming. Like in any other profession, lawyers in Ontario are not immune to being sued for lawyer/solicitor's negligence, and for legal malpractice.

You failed to meet standards of professional competence for the purposes of the Law Society Act, R.S.O. 1990, c. L.8 (the 'LSA'), with deficiencies in knowledge, skill, judgment, attention to the interests of clients, records, systems, and procedures of your professional business.

These deficiencies gave rise to a reasonable apprehension that the quality of your service to clients was adversely affected. You stated and implied an ability that you do not possess.

Your handling of this case is not up to the standard of skill and care expected of a competent lawyer.

Your professional incompetence brings discredit upon the legal profession.

You are also engaging in conduct which undermines the administration of justice.

You are taking improper advantage of the youth, mentally ill, inexperienced, and lacking education.

The deception and the fraud perpetrated on the parents by you is conduct unbecoming of a barrister. It contravenes s. 33 of the LSA.

The Law Society of Ontario has announced a new mediation program to help deal with complaints of this nature. One has to wonder how they will use mediation to handle incompetence, corruption and right the damages done.

I will be filing a complaint with the Law Society of Ontario for a conduct order against you pursuant to s. 35(1)3(iii), 4, 6, 7, 7.1, 8(iii), 9, 15(iii), 19, and 21 of the LSA.
